Adoption  

Our firm can represent both adoptive parents and birth parents in legal adoption proceedings in the State of Minnesota. However, if ever approached to represent both birth parents and adoptive parents in the same proceeding, we can only represent one party and will generally refer the other party to another law firm that specializes in adoptions.

Our firm is mostly called upon to assist in relative adoptions. Examples of such adoptions are when a step-parent wishes to adopt his or her step-child; when an Aunt or Uncle wishes to adopt his or her niece or nephew; or when a grandparent wishes to adopt his or her grandchild. In all such proceedings, the birth mother and birth father (and any putative fathers) have rights that must be adhered to by the Court. In addition, the County where the child resides must usually consent to the adoption before it can be approved by the Court.

Our firm can assist with both "agency" and "direct" adoptions. In agency adoptions, the birth parents transfer their legal rights for the child to be adopted to the State of Minnesota or an adoption agency. Examples include foster care or international adoptions. With direct adoptions, we can assist both birth parents or adoptive parents. Direct adoptions are where the birth parents transfer their legal rights of their child directly to the adoptive parents. As stated above, we can only represent one side in such a proceeding.

It is important to note that our firm is not an adoption agency. We will not act to bring adoptive parents and birth parents together. We will not locate children for adoptive parents to adopt and we will not locate adoptive parents for birth parents who want to give up their children for adoption. In the event we receive such inquiries, we generally refer that individual to the appropriate agency and then encourage the individual to contact our firm when he or she is prepared to proceed with the adoption.

Despite what many people believe, adoption proceedings are very complex. They generally impact the rights of many individuals, including those who are not always known to the central parties of the proceeding. The most important part of any adoption is to make sure that the adoption is final once it has been approved by the Court. Therefore, no matter which side of the adoption proceeding an individual may be on, it is always recommended that the individual obtain experienced legal representation to guide him or her through the difficult process.
