Driving Offenses

Many individuals are charged with misdemeanor and petty misdemeanor driving offenses for conduct that, unknown to them, is illegal. It is a crime in this state to drive without automobile insurance, to drive without proof of automobile insurance and to have an outdated address on a driver’s license, among other actions.

What makes some driving offenses difficult to deal with is that if an individual pleads guilty to some of the offenses the plea may result in the revocation of driving privileges. Some of these convictions are also enhanceable, meaning that should more than one conviction take place within a range of time it may result in a gross misdemeanor.

It is imperative that each driving charge, as minor as it may seem, be analyzed to determine what effect a conviction would have on driving privileges and, possibly, insurance rates. Many prosecutors offer first-time offenders a plea agreement which would allow them to maintain their driving privileges, but prosecutors are not in control of license revocation and any agreement should be reviewed before it is finalized.
