Theft

Theft charges range from petty misdemeanors to felonies. Prosecutors will determine the severity of the charge based on the amount of money or property involved in the crime.

Some counties offer special programs to assist individuals to keep their criminal records clear of a conviction. Most programs of this nature will mandate the offender to sign an admission of guilt, pay a program cost, require regular meeting attendance and will ask the individual to pay “restitution”, or the out of pocket expenses incurred by the victim.

If a person is required to pay restitution the prosecutor is required to provide an Affidavit of Restitution to detail the exact amount of money being requested by the victim. The offender is entitled to a restitution hearing to challenge some, or all, of the funds being requested. There are strict time limits for requesting the hearing that, if left to pass, will forever bar an individual from challenging the amount of restitution.
