Visitation / Parenting Time  

Visitation or Parenting Time are terms used to describe the access schedule granted to a parent who does not have primary physical custody or to parents who have joint physical custody of their minor children. As in custody cases, Courts in Minnesota consider the "best interests" of the minor children in determining the appropriate parenting time for each parent. The Court considers the age and maturity of the children, the capacity of the person requesting parenting time to appropriately parent his or her children and, of course, the nature of the relationship between the parent and his or her children.

Much like custody cases, visitation issues can become very emotional and frustrating for parents and children alike. There are mediation and visitation expeditor services for parents available through Domestic Relations at most county courthouses. If these efforts fail, a parent should always consult with an experienced family law attorney before proceeding to Court to make sure that his or her rights are protected from the inappropriate actions of a custodial parent or the inappropriate involvement of a non-custodial parent.
